In November 2020, South Dakota voters approved an initiative and Constitutional amendment that would have opened up the medical and adult-use markets. After a challenge from South Dakota Gov. Kristi Noem, the state Supreme Court made a ruling that hung on a technicality — and only the medical market went into effect, with the first dispensaries opening in 2021.
Voters voted down adult-use legislation in November 2022.
There is already a healthy medical cannabis market in South Dakota, with scores of licensed dispensaries, manufacturing facilities, and cultivators. The state had 3,768 approved patient cards as of Oct. 13, 2022.
- Cannabis Job Requirements & Application Process:
Plant-touching cannabis workers in South Dakota are called Medical Cannabis Establishment Agents. There are currently no official forms or licenses for workers in the South Dakota cannabis industry.
In order to become an agent, these are the requirements:
- 21 years of age or older
- Pass a background check
Employers are required to create an identification badge for each agent
- Cannabis Job Background Check Requirements:
Each medical cannabis establishment is required to conduct a background check of every employee. They must deny you employment if you were convicted of a disqualifying felony offense.
A "disqualifying felony offense" is defined as a violent crime that was classified as a felony in the jurisdiction where the person was convicted.
