North Dakota citizens voted down Measure 2, which would have opened up the adult-use market, in November 2022.
As of 2016, North Dakota voters approved Measure 5, or the North Dakota Compassionate Care Act, which established a medical cannabis program. This program became effective in April 2017.
As of October 2022, there were 8,499 active patient cards registered by the state, two registered manufacturing facilities, and eight registered dispensaries.

Plant-touching cannabis workers in North Dakota are called Compassion Center Agents.
This is what's required to obtain a Compassion Center Agent registry identification card:
- 21 years of age or older
- Photographic copy of government issued identification
- A recent 2” x 2” photograph
- A written and signed statement from an officer or executive staff member of the compassion center stating the applicant is associated with the compassion center and what that association is
- Name, address, telephone number of the agent
- Name, address, telephone number of the compassion center with which the agent is associated
- Agent’s signature and the date
- A nonrefundable application fee of $200
- Consent to undergo a criminal history record check (paid for by the compassion center or agent)
- Cannabis Job Background Check Requirements:
An individual convicted of a drug-related misdemeanor offense within the five-year period before the date of application, or a felony offense, is prohibited from being a compassion center agent.
